Working Together to Protect Health, Pollinators, and the Environment – Highlights

The Québec Pesticide Strategy 2015–2018 includes measures to improve agricultural practices. These measures, which target heavy pesticide users and the pesticides that pose the greatest risks, aim to better protect health, pollinators, and the environment. As a result of the changes made to the regulations in force since 2003, Québec is now a leader in the management of pesticides in agricultural areas.

Main amendments

In agricultural areas:

  • Group neonicotinoids coating seeds of certain crops into a new class of pesticides, Class 3A
  • Subject the sale and use of pesticides in this new class to a permit and certificate system at the same time
  • Require compliance with certain storage requirements for Class 3A pesticides
  • Prohibit the application of the highest-risk pesticides for agricultural purposes and the application of Class 3A pesticides into or on the soil, unless an agronomic justification signed by an agrologist has been obtained in advance
  • Require retailers to sell pesticides covered by an agronomic justification only to those who provide a valid prescription signed by an agrologist
  • Require compliance with existing mandatory distances from lakes, watercourses, wetlands, water withdrawal sites, and ditches during the application of Class 3A pesticides into or on the soil
  • When pesticides are applied by aircraft near bike paths that are physically separated from vehicular traffic and have their own right-of-way, require that the same mandatory distances are maintained as for protected buildings
  • Require farmers to keep an up-to-date register of their pesticide use, including information on Class 3A pesticides
  • Require wholesalers to annually report to Ministère their sales of Class 3A pesticides
  • Require retailers to annually report to Ministère:
    • Their sales of pesticides covered by agronomic justifications
    • Their purchases of pesticides that are not from wholesale permit holders

In urban areas:
  • Prohibit the sale of neonicotinoids intended for application to turf surfaces to consumers and the application of these pesticides to such surfaces by commercial users, except on golf course surfaces
  • Allow the free sale to consumers of biopesticides and synthetic pyrethrin analogues by grouping them in Class 5
  • Provide details on the sale of multipacks of household pesticides
  • Allow the injection of pesticides to control the emerald ash borer on daycare and school grounds
  • Allow the application of a pesticide containing D-phenothrin and tetramethrin to destroy wasp, hornet, or bee nests on daycare and school grounds

Other amendments

  • Permits and certificates: Adjust different classes or subclasses of permits and certificates
  • Fumigation: Require a fumigation permit or certificate to use sulfuryl fluoride and magnesium phosphide
  • Transport corridors: No longer require a report on pesticide application work to be sent to Ministère
  • Register of purchase, sale, or use: Require information to be compiled in a document designed for this purpose. Invoices no longer serve as registers
  • Protected buildings: In the definition of “protected building,” delete the reference to buildings used or intended to be used to house or receive things
