Draft Regulation to amend the Regulation respecting mandatory reporting of certain emissions of contaminants into the atmosphere

Public consultation from September 30 to November 13, 2020

The Regulation respecting mandatory reporting of certain emissions of contaminants into the atmosphere (RMRCECA) makes it possible to obtain data used under the cap-and-trade system for greenhouse gas emission allowances (C&T system). However, in order to ensure that the C&T system is functioning properly, some changes must be made to the RMRCECA.

The main changes proposed in the Draft Regulation to amend the Regulation respecting mandatory reporting of certain emissions of contaminants into the atmosphere are as follows:

  • Global Warming Potentials (GWPs) need to be updated as they will have to be used to report emissions for 2021, the start of the C&T system’s new compliance period;
  • In order to ensure the C&T system’s integrity, coverage of emissions transferred to another establishment is required by the first establishment that generated the GHG emissions, except when they are used in the manufacture of chemical products;
  • With the entry into force of federal carbon pricing, emissions stemming from the importation of electricity produced in Canadian provinces or territories that are subject to it should no longer be taken into account;
  • Emission factors that fuel distributors must use need to be updated, particularly to take the new GWPs into account.

This draft regulation is currently the subject of a 45-day public consultation. All interested parties may submit their comments in writing by November 13, 2020, to the following address:
